Privacy Policy

Account information, including your name, email address, authentication provider identifiers, team membership, invite status, subscription status, and preferences.

Workspace and product data that you choose to create or connect, including project metadata, terminal session metadata, file and attachment metadata, chat and agent messages, routine and proposal data, memory and context records, seed pack records, logs, settings, and similar operational content.

Machine connection data, including device names, machine identifiers, tunnel or connection metadata, status signals, and diagnostics needed to connect your local Orchard environment to Orchard services.

Payment and billing information processed by our payment providers. We do not intentionally store full payment card numbers on Orchard systems.

Usage, device, and security data, including browser type, operating system, IP address, pages visited, request timestamps, authentication events, error reports, and audit logs.

Support communications and other information you send to us directly.

Advertising and analytics identifiers and cookies. We and our advertising partners (Google, Meta, X, and LinkedIn), delivered through Google Tag Manager, set cookies and collect device and usage identifiers and events (such as pages viewed, downloads, and sign-ups) to measure campaigns, attribute conversions, and show relevant ads.

We use information to provide, secure, troubleshoot, and improve Orchard, including authentication, team collaboration, machine connectivity, file access, agent workflows, AI features, billing, support, abuse prevention, and service reliability.

We may use operational records and diagnostics to understand product performance, investigate incidents, prevent fraud or misuse, comply with law, and enforce our terms.

We do not use private workspace content to train third-party foundation models unless you separately agree to a feature or setting that clearly says otherwise.

Some Orchard features send prompts, files, logs, transcripts, or other content you provide to AI model providers, infrastructure providers, payment processors, analytics or diagnostic providers, email providers, and hosting providers so those providers can perform services for Orchard.

Those providers may process information in the United States and other locations where they or their subprocessors operate. We require service providers to use information only to provide services to us, except where their own terms apply to a third-party integration you choose to use.

We share information with service providers that help us operate Orchard, with team members or administrators according to your workspace permissions, with integration providers you authorize, and when needed for security, legal compliance, corporate transactions, or protection of rights and safety.

We do not sell personal information in the ordinary sense of exchanging it for money. We do share online identifiers and advertising events with advertising partners (Google, Meta, X, and LinkedIn) for cross-context behavioral advertising, including campaign measurement and remarketing. You can opt out as described in "Your choices and rights" below.

We keep information for as long as needed to provide Orchard, maintain security and audit records, comply with legal obligations, resolve disputes, and enforce agreements.

You may request access, correction, export, or deletion of personal information by contacting privacy@orchardai.ai. Some records may remain in backups, security logs, billing records, or other legally required archives for a limited period.

Depending on where you live, you may have rights to know, access, correct, delete, export, restrict, or object to certain processing of personal information.

California residents may request details about the categories of personal information we collect, the purposes for collection, the categories of recipients, and the rights available under California privacy law.

You can control many account and workspace settings inside Orchard. You can also unsubscribe from non-transactional emails using the instructions in those emails.

You can opt out of advertising and analytics cookies by emailing privacy@orchardai.ai, by using your browser or device privacy controls, and through each advertising partner's ad settings (for example, Google Ads Settings and the Meta, X, and LinkedIn ad preference controls).

We use administrative, technical, and organizational safeguards designed to protect information, including access controls, encryption in transit, provider security controls, and monitoring. No method of transmission or storage is completely secure.

Orchard is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

We may update this Privacy Policy from time to time. The effective date above shows when this version took effect.
